Please read our terms and conditions carefully in addition to the terms and conditions of the cruise line or other service provider your holiday is booked with. You are bound by their terms and conditions including cancellation and change policies. A link to a copy of the terms and conditions of the cruise line or tour operator will be sent to you at the time of booking.

If you or any member of your party have any disabilities, health or dietary concerns, it is extremely important that we make the necessary arrangements to make your holiday go smoothly. We must therefore insist that you contact us before completing any reservation to ensure compatibility for the holiday that you chose.

In these Terms and Conditions, "you" and "your" means all persons named on the booking (including anyone who is added or substituted at a later date) or any of them, as the context requires, however the lead passenger holds ultimate responsibility for all passengers. "We", "us" and "our" means Faraway Shores Travel Ltd. 'Principles' (supplier) are the tour operator or supplier of travel services who is contractually bound to provide your travel services either directly to the customer or through a travel agent.

1.Far away Shores Travel - Who are we?

Faraway Shores Travel Ltd is a small independent travel agency working for 'Principles' selling their package holidays and other services to customers.

Faraway Shores Travel Limited (a company registered in England and Wales under number 14824473, whose registered office is 6 Main Road, Weston, Crewe CW2 5NA) is a member of the Travel Trust Association (TTA) and abide by the 'Code of Conduct' for its members. Our TTA membership number is 23555 and can be confirmed by contacting TTA at https://thetravelnetworkgroup.co.uk/faqs.

As a Travel Agent with TTA we deposit money received from our customers into a 'Trust Account' which is designed to protect you the customer with 100% financial protection and being able to book in confidence. The Trust Account is a bank account designated to hold our customer's money, where it remains until payment is due to the supplier. When paying the supplier, this is supervised by an appointed Trustee who is either a banker, chartered or certificated accountant or a solicitor. Both Faraway Shores Travel and the Trustee are required to authorise payments from the Trust Account. Therefore, the Trust Account will ensure that all the money which you have paid is safely protected and is further protected by a financial guarantee from The Travel Trust Association. It means that you can book your holiday secure in the knowledge that Travel Trust Association will protect you in the unlikely event of Faraway Shores Travel financially fail or cease trading.

2. Making a Booking

The first named person on the booking (lead passenger) must be authorised to make a booking on the basis of these booking conditions by ALL persons named on the booking and by their parent or guardian for all members who are under 18 years when the booking is made. The lead passenger must be over 18 years of age to make a booking and is responsible for all payments for all named passengers on the booking. When a booking is made all details will be read back to you for confirmation of these details. Please ensure you check all names, spelling, dates and timings are correct on receipt of all documents and advise us of any errors immediately.

For all arrangements we act as your agent, your contract for the supply of the service(s) will be the disclosed supplier of the service(s) in question. When making your booking, we will arrange for you to enter into a contract with that supplier. Your booking will be subject to the supplier's terms and conditions with our booking services, You are advised to read all applicable terms and conditions carefully prior to confirming your booking. Except where otherwise stated, Faraway Shores Travel ltd do not accept liability in relation to any contract you enter into or for any arrangements you purchase or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with any arrangements.

For the avoidance of doubt, where we sell you a Package holiday that has been organised by another supplier, we will sell that holiday as an agent for that supplier. Where that Package holiday includes a flight, the flight will be protected by the supplier's ATOL and the ATOL Certificate will be issued by us on behalf of that supplier.

These booking conditions and any agreement to which they apply are governed in all respects by English law. We and you agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of England and Wales only. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you live in those places and if you wish to do so.

3. ATOL Protection

The package holidays with flights shown on your booking are ATOL protected by the Civil Aviation Authority. We act as agents only for licensed tour operators ('Principles'). Their relevant ATOL number and ATOL certificate will be provided for each holiday booked with that tour operator ('Principles'). The certificate lists what is financially protected, where you can get the information on what this means for you and who to contact if things go wrong or are not to your satisfaction.
As travel and booking agents we act only as agents for the Principals actually providing the relevant services and we shall not be liable for any act or default on the part of any such Principal or its agents. Passengers are booked and/or tickets and coupons are issued or obtained by us subject to the condition's regulations and terms of the Carriers and/or Principals concerned.

4. Travel Information

Please note that we can only provide general information about the passport and visa requirements for your trip, but your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. Any information supplied by us on these or related matters (such as climate, when to travel, clothing, baggage, personal items etc.) is given as general guidance and in good faith but we do not accept liability for any decisions made on the basis of the information supplied.

The passport, visa and health requirements at the time of booking can be viewed on the Foreign and Commonwealth Office website (www.fco.gov.uk). It is your responsibility to ensure that you and all members of your party are in possession of all necessary travel and health documents, and in compliance with any other immigration requirements, before you travel. If you or any member of your party is not a British Citizen or hold a non-British Passport, you must check passport and visa requirements with the embassy or consulate of the country(ies) you are travelling to or through. Neither we, nor the supplier(s) of travel services, accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.

Note: Clients travelling to the U.S. must apply for their visa (esta) prior to departure on the following website https://esta.cbp.dhs.gov (there will be a minor charge for this service). The Esta is generally valid for multiple trips over a period of 2 years, but do check your status before you travel to be sure.

Please ensure that all your travel, passport, visa and insurance documents are in order and that you arrive in plenty of time for checking in at the airport. It may be necessary to reconfirm your flight with the airline prior to departure.

5. Payment

All prices quoted are subject to change until a booking is confirmed.
You will be required to pay a deposit and/or make full payment for your booking at the time of booking. Where you only pay a deposit, you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the principal(s) or supplier(s) who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions, plus any expenses occurred by Faraway Shores Travel Ltd in the process of the booking.

We reserve the right to adjust prices and times given or quoted should circumstances make it necessary. Prior notice will be given in most circumstances, but we can only guarantee against fare increases when the full balances are paid in full at time of booking.

6. Cancellation & Amendments

You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking must be received at our office. Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges outlined by the principles/ suppliers and an additional administration fee of £10pp. Detailed information is found in the principles/supplier's terms and conditions. Any amendments to your bookings may incur a charge by the principles/ supplier. Please check the details in your booking documentation supplied with your booking, normally found in the terms and conditions.

7. Website & Social media

Advertised Prices are 'per person' based on 2 sharing (unless stated) and are subject to availability and change. Hotels are subject to availability and change, if fully booked, local hotels of a similar standard will be offered as an alternative. Hotel ratings are based on local standards. Tours are subject to availability and change and some tours may command a supplementary cost. Ports of call on some coach tours/cruises may vary according to unforeseen circumstances. All deals are fully TTA & ATOL protected.

Changes to Our Site
We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, or any content on it, will be free from errors or omissions.

No Reliance on Information
The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

8. Insurance

It is a booking condition of package travel regulations that you have adequate travel insurance. Passengers must take out travel insurance and a referral to a provider can be made available if required. Neither we nor any of our suppliers shall be liable or responsible for any loss, damage, or injury incurred. Any delay or inconvenience whatsoever to any traveller or their luggage or other personal property sustained, or during any passage, journey, trip or stay, or in respect of any accommodation or in the carrying out of any arrangements booked through us, and responsibly for insurance lies with you the passengers.
We offer insurance via a partner operators as a referral only, and cannot supply insurance directly.

9. Complaints/Conduct

If you have a problem during your holiday, please inform the relevant supplier (e.g. your hotelier, flight provider etc) immediately, who will endeavour to put things right. It is strongly recommended that you communicate any complaint to the supplier in writing of the services in question without delay and whilst in resort, which you should keep a copy of for records.

You accept responsibility for the proper conduct of all members of your party during your holiday. The suppliers of travel services reserve the right at any time to terminate the holiday of any party member(s) whose behaviour is such, in the reasonable opinion of the supplier, to cause or to be likely to cause danger, upset, harassment or distress to anyone else or damage to other persons or to property. No refund will be given in the event of you, or any member or your party, being requested to cease your holiday in such circumstances. Furthermore, we shall be under no obligation whatsoever to pay compensation to you or any member of your party, or meet any costs or expenses (including but not limited to alternative accommodation) you, or any member of your party, may incur as a result of your stay being terminated in accordance with this clause.

If you, or any member of your party, cause damage to any accommodation in which you are staying or to any property of suppliers of tours, excursions or other elements of your holiday arrangements, you must fully reimburse the accommodation provider or relevant supplier concerned for the cost of the damage before the end of your holiday (if the cost has been established by then), or as soon as it has been established if later.

10. Data Protection

Information you have provided to us for your booking will be forwarded on to the relevant suppliers of your holiday, so that the travel services can be provided to you. This applies to any sensitive personal data that may have been provided to us when making your booking for the purposes of arranging your holiday. As this data may need to be transferred outside the European Economic Area in order for your holiday to be provided to you, then you agree that we may transfer your data (and the data of those in your party) to those suppliers for this purpose. 11. Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales and the jurisdiction of the English courts. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so.

12. Arbitration

It is unlikely that you will have a complaint that cannot be settled amicably between you and the suppliers. However, disputes arising out of or in connection with any contracts with your suppliers should be brought to our attention at the earliest opportunity (no later than 14 days of completion of holiday) to enable the suppliers to resolve matters as quickly as possible. If the matter cannot be settled amicably, you may wish to seek to use the special arbitration scheme operated through the TTA, which is administered by the Chartered Institute of Arbitrators. The scheme provides for a simple inexpensive method of arbitration on documents alone, with restricted liability on the customer in respect of costs. Whether the scheme can be used will depend on the claim being brought, however for further details please see the TTA website at www.traveltrust.co.uk, including providing full details of the complaint.
